Terms & Conditions for Artwork

These Terms & Conditions govern the purchase, commission, and use of artwork from us through BillSullivanArt.com. By purchasing artwork from us, you agree to these terms.

1. Original Artwork

All original artworks are unique, one-of-a-kind pieces. Minor variations in color, texture, or detail may occur due to lighting, photography, or display differences. Such variations are not considered defects.

2. Prints and Reproductions

Prints are reproductions of original artwork and may vary slightly from images displayed on the website. Print sizes and editions (if applicable) are described in the artwork listing.

Limited edition prints, if offered, are produced in a fixed quantity and may be signed and/or numbered as stated in the listing.

3. Pricing and Payment

All prices are listed in US Dollars. Payment is due in full at the time of purchase unless otherwise agreed in writing.  We reserve the right to change prices at any time. Taxes, shipping, and handling fees (if applicable) are paid by buyer and will be calculated at time of purchase.

Payments are processed securely through third-party payment providers. We do not store full payment details.

4. Shipping and Delivery

Artwork will be shipped to the address provided at checkout.

• Shipping times are estimates and may vary due to location or carrier delays.
• We are not responsible for delays caused by shipping carriers or customs.
• Buyers are responsible for providing accurate shipping information.
• All Artwork will have insurance in the event Art is damaged during transit. If artwork arrives damaged, please review carriers’ policies and ensure you have photographs of the damage and packaging.

For international orders, buyers are responsible for any customs duties or import taxes.

5. Returns, Refunds, and Exchanges

• Artwork and prints are final sale and non-refundable. 

6.  Copyright and Intellectual Property

All artwork remains the copyrighted property of Heather and Colette Sagar even after purchase.

Purchase of artwork does not transfer copyright or reproduction rights. Buyers may not:

• Reproduce, copy, or distribute the artwork
• Use the artwork for commercial purposes
• Create derivative works

Personal display and enjoyment of the artwork are permitted.

7. Image Usage

We reserve the right to photograph and display images of artwork (including commissioned pieces) for portfolio, website, social media, or promotional purposes unless otherwise agreed in writing.

8. Care and Handling

Artwork should be handled and displayed according to standard art care practices. We are not responsible for damage caused by improper handling, framing, environmental conditions, or normal wear over time.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from the purchase or use of artwork.

Our total liability shall not exceed double the purchase price of the artwork.

10. Governing Law

These Terms & Conditions are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

11. Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time. Updates will be posted on this page with a revised “Last updated” date.
